What Should I do if I’m hit by a Drunk Driver?

Mothers Against Drunk Driving (MADD) estimates that someone is injured by a drunk driver every 2 minutes.

1.Prioritize safety. Check yourself and the passengers to see how they feel. Have someone call 911 to report the accident and send an ambulance. If there are no serious injuries or trauma, try to move yourself and the vehicles to safety on the side of the road. If there are serious injuries or heavy traffic, wait for the police to arrive.

2.Exchange Information and Stay Calm. It’s very easy to be angry and let your emotions get the best of you in these situations. But the best thing you can do is remain calm and obtain information. If they don’t want to give you their information, wait for police to arrive to report the incident.

3. Use Your Smart Phone to Take Pictures. You can use your smartphone to take pictures of the scene, witness contact information, driver’s licenses, insurance information, and more. Include vehicle damage, injury, skid marks, obstructed views, etc. These could all play an important role in your case.

4.Tell the Police Your Suspicion of Intoxication. When the police arrive, let them know you believe the person may be intoxicated. Make sure to note who was driving because if another passenger is sober, they may try to say they were the one driving. Don’t assign blame or assume anything, only tell the facts of what happened.

5. Get Medical Attention. If your injuries aren’t life-threatening or severe, you may not need to go to the Emergency Room. However, you will still want to seek immediate medical attention from a licensed professional. This is important not only for your health but to make sure you’re properly compensated for injuries you’ve sustained. Don’t be fooled into thinking you aren’t injured—it’s something that’s very easy to do. Get yourself checked out to be safe!

6. Speak With a Knowledgeable Personal Injury Attorney. Insurance companies will tell you don’t need an attorney. This is just one of many tricks and myths they use to either deny claims or devalue them. A seasoned auto accident lawyer will help you navigate insurance company traps.
